Terms of Service

 

Welcome to racoman.ca (the “Site”), operated by Raco (“Raco,” “we,” “us,” or “our”). By accessing or using this Site, placing an order, creating an account, or otherwise using our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Site.

1. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

  • in any way that violates any applicable law or regulation;
  • to transmit or introduce viruses, malicious code, or harmful material;
  • to interfere with the Site’s operation, security, or functionality;
  • to attempt unauthorized access to any part of the Site, our systems, or other users’ accounts;
  • to copy, scrape, reproduce, distribute, or exploit Site content without our prior written permission.

We may suspend or terminate access to the Site at any time if we believe a user has violated these Terms or applicable law.

2. Eligibility

By using this Site, you represent that you are at least the age of majority in your province, state, or territory of residence, or that you are using the Site under the supervision of a parent or legal guardian who agrees to these Terms.

3. Products and Services

Raco sells truck parts and related products through the Site. Product availability, descriptions, pricing, specifications, images, colors, compatibility details, and other content may change at any time without notice.

We strive to ensure that product descriptions are accurate. However:

  • product images are for general illustration and may not reflect every detail;
  • color, finish, condition, and appearance may vary depending on lighting, screen display, handling, and the individual product;
  • fitment, compatibility, year range, trim, and installation suitability must be independently confirmed by the customer before purchase.

Unless expressly stated otherwise in the product listing, no statement on the Site should be interpreted as a guarantee that a part is suitable for your specific vehicle, use case, or installation method.

4. Product Fitment and Customer Responsibility

You are solely responsible for verifying that any product you purchase is correct for your vehicle, including make, model, year, trim, bed length, configuration, mounting style, and any other relevant specifications.

Before placing an order, you should carefully review the product description and contact us if you need clarification. Failure to verify compatibility before purchase does not make the product defective.

We are not responsible for losses, delays, costs, or damages arising from:

  • incorrect orders placed by the customer;
  • assumptions about compatibility;
  • improper installation;
  • modifications to a vehicle or part;
  • use of a product outside its intended purpose.

5. Orders

All orders are subject to acceptance and availability. After you place an order, you may receive an order confirmation email. This confirmation does not mean that your order has been accepted. We reserve the right to refuse, limit, cancel, or modify any order for any reason, including:

  • product unavailability;
  • suspected fraud or unauthorized transactions;
  • pricing or listing errors;
  • shipping limitations;
  • errors in customer information.

If we cancel an order after payment has been authorized or captured, we will issue a refund in accordance with our applicable refund practices.

6. Pricing and Payment

All prices displayed on the Site are in Canadian dollars (CAD) unless otherwise stated. Taxes, shipping charges, freight charges, duties, and other fees, if applicable, may be added at checkout or after order review depending on the product and delivery method.

We reserve the right to correct pricing errors, typographical errors, or inaccuracies at any time, including after an order is placed. If a pricing error affects your order, we may contact you with the option to proceed at the corrected price or cancel the order.

Payment must be successfully authorized before an order is processed or shipped. We may use third-party payment processors and ecommerce platforms to process transactions securely.

7. Shipping, Delivery, Freight, and Pickup

Certain products sold on the Site may be oversized, heavy, freight-classified, or require special handling. Shipping and delivery times are estimates only and are not guaranteed unless expressly stated by us in writing.

For freight or large-item deliveries:

  • you must provide an accurate delivery address and contact information;
  • you are responsible for ensuring the delivery location is accessible;
  • additional charges may apply for remote locations, redelivery, storage, liftgate service, residential delivery, or failed delivery attempts;
  • you may be required to be present to inspect and accept the shipment;
  • where applicable, curbside delivery may be the default service level unless otherwise agreed.

Risk of loss may pass to you upon delivery to the shipping carrier, or upon delivery to the address provided by you, unless otherwise required by applicable law.

If local pickup is offered, you must collect the order within the timeframe communicated by us, using valid identification and any required pickup confirmation.

8. Inspection on Delivery

You must inspect your order promptly upon delivery or pickup.

If a package or freight shipment arrives visibly damaged, you should:

  • note the damage on the delivery receipt before signing;
  • take clear photographs of the packaging and product;
  • notify us as soon as possible, and in any event within 48 hours of delivery.

Failure to inspect and report damage promptly may limit our ability to assist with freight claims, carrier claims, replacement requests, or other resolutions.

9. Returns, Refunds, and Cancellations

Any returns, refunds, exchanges, cancellations, or store credits are subject to our posted Refund Policy, if any, and any product-specific conditions stated on the Site.

Unless otherwise required by law or expressly approved by us in writing:

  • special-order items, freight items, clearance items, and installed items may be non-returnable;
  • original shipping, freight, handling, and delivery charges are non-refundable;
  • return shipping and restocking charges may apply;
  • returned items must be in the same condition as received and must not have been installed, altered, painted, modified, or damaged by the customer.

Orders may not be cancelled once they have been processed, prepared for shipment, shipped, or specially sourced, except at our discretion.

10. Installation and Safety Disclaimer

Vehicle parts should be installed only by qualified persons using appropriate tools, methods, and safety procedures. You are solely responsible for ensuring proper installation, inspection, maintenance, and use of any product purchased from the Site.

We are not responsible for injury, death, property damage, towing costs, labor costs, shop charges, diagnostic costs, downtime, loss of use, or any other damages arising from:

  • improper installation;
  • improper storage or handling;
  • misuse or abuse;
  • failure to inspect a product before or after installation;
  • failure to follow manufacturer, mechanic, or industry recommendations.

11. No Professional Advice

Information on the Site is provided for general informational purposes only and does not constitute mechanical, engineering, legal, or safety advice. You should consult a qualified technician or mechanic before purchasing or installing parts if you are unsure about compatibility or installation requirements.

12. Warranties Disclaimer

To the fullest extent permitted by applicable law, the Site and all products and services offered through it are provided on an “as is” and “as available” basis.

Except as expressly stated in writing by Raco, we disclaim all representations, warranties, and conditions, whether express, implied, statutory, or collateral, including any implied warranties or conditions of merchantability, fitness for a particular purpose, durability, title, accuracy, compatibility, or non-infringement.

Nothing in these Terms excludes any non-waivable rights you may have under applicable consumer protection laws.

13. Limitation of Liability

To the fullest extent permitted by law, Raco and its owners, officers, directors, employees, contractors, affiliates, agents, service providers, and licensors shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, revenue, business, savings, opportunity, data, goodwill, or use, arising out of or relating to:

  • your access to or use of the Site;
  • your inability to access or use the Site;
  • any product purchased through the Site;
  • delays in shipping or delivery;
  • installation issues;
  • product incompatibility;
  • errors, interruptions, bugs, or security incidents.

To the fullest extent permitted by law, our total aggregate liability for any claim relating to a product or order shall not exceed the amount actually paid by you to us for that product or order.

14. Indemnification

You agree to indemnify, defend, and hold harmless Raco and its affiliates, owners, employees, contractors, agents, service providers, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • your breach of these Terms;
  • your misuse of the Site;
  • your violation of any law or third-party right;
  • your installation, resale, or use of any product purchased from the Site.

15. Intellectual Property

All content on the Site, including text, graphics, logos, photographs, images, product listings, page layouts, designs, software, and other materials, is owned by or licensed to Raco and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, republish, display, transmit, or exploit any Site content without our prior written consent, except for personal, non-commercial use directly related to shopping on the Site.

16. Third-Party Services and Links

The Site may use or link to third-party services, platforms, apps, financing providers, payment processors, logistics providers, or other websites. We do not control and are not responsible for third-party content, terms, privacy practices, financing decisions, carrier performance, or external services.

Your use of third-party services may be subject to separate terms and conditions.

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information when creating an account, placing an order, or contacting us. We may suspend or terminate accounts containing false, incomplete, or misleading information.

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, weather events, strikes, labor shortages, supply chain disruptions, carrier delays, border issues, customs delays, cyber incidents, government action, or interruptions in utilities, internet, or hosting services.

21. Termination

We may terminate or suspend your access to the Site, cancel orders, or refuse service at any time, without notice, if we believe you have violated these Terms, applicable law, or the security or integrity of the Site.

Any provisions that by their nature should survive termination will survive, including provisions relating to intellectual property, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution.

22. Governing Law

These Terms and any dispute arising out of or relating to the Site, any order, or any transaction with Raco shall be governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that the courts located in Nova Scotia shall have exclusive jurisdiction over any dispute, claim, or controversy arising from or relating to these Terms or your use of the Site, except where applicable law requires otherwise.

23. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severed and shall not affect the validity and enforceability of the remaining provisions.

24. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

25. Changes to These Terms

We reserve the right to update, change, or replace these Terms at any time by posting the revised version on the Site. The updated Terms will be effective as of the “Effective Date” shown above, unless otherwise stated. Your continued use of the Site after any changes are posted constitutes your acceptance of those changes.
